Can I claim for my bike?

Yes we can help you value your bike and claim the cost of it or the repair cost depending upon age /value etc.

Can I claim accessories and kit?

Yes anything that is damaged can be claimed for. You should keep all the damaged items for inspection and if you have them provide the purchase receipts. 

Do Wiggle Legal provide rehabilitation?

Yes all accepted cases are triaged for treatment and if required it is arranged for you at a convenient time and location.

What medical evidence do I need to start a claim?

It’s always a good idea to see your GP to discuss your injuries or to attend hospital to have them assessed as it puts the injury on record. We’ll do the rest.

How are my injuries assessed?

We will arrange an independent medical examination that will then produce a report evidencing your injuries. We use this as an aid to valuation from tables and previous court awards.

How will my claim be funded?

Wiggle Legal will explore the best option for you. If you have existing insurance we may be able to use it. If not we have a variety of funding options. These can include:

  • Using existing insurance you may have
  • Union Membership
  • Legal expenses cover attached to holiday insurance
  • No win no fee (conditional fee agreement)
  • Both sides costs insurance

What does it cost me?

We operate a no win no fee service so that you pay nothing unless we win your case. If you win we deduct up to 25% including VAT. We do not take any percentage from the value of your bike or your kit or any medical treatment that forms part of the claim.

Do I pay Tax on my award?

No tax is payable on damages awards (compensation).

How are compensation payments calculated?

We start with the items you’ve lost and value these with receipts or other evidence of the value and then look at other losses such as earnings and calculate these. To this we add a value for the injury by discussing the medical evidence with you and advising you on value before submitting any offer. The claimant normally makes the first offer.

What medical evidence should I need?

We’ll arrange the medical examination for you. This is distinct from any treatment you need. You should visit your GP for any treatment unless you have already been treated or referred to the hospital.  The medical that we arrange is for the purpose of valuing the claim.

What if liability for my accident is denied by the other party?

In most cases a formal liability decision will take 30 days from submitting the formal notification to the other parties insurance company. If this isn’t forthcoming then we help you gather the evidence to prove fault by interviewing any witnesses, getting the police report or obtaining photographs of the location and or the damage.

What next if liability is admitted?

Once this has been formally admitted by the other parties insurer we’ll start to gather the evidence to value your claim and submit it with medical evidence and an offer to settle approved by you.

Do I need independent witnesses to my accident?

It’s always helpful to have details of a person that saw what happened. They don’t have to be independent but it helps.

What if the driver didn’t stop or wasn’t insured?

Don’t worry. We have a team of specialists that deal with such cycling accident claims cases and can pursue them against the Motor Insurers Bureau who pay such claims.
