Making a claim for compensation is a legal process based on evidence. Camera phones have made claiming much more straightforward. If you’re involved in an incident or an accident, take as many photographs as you can – or ask someone else to take some for you.

There is a lot you can claim for, including compensation for injury, costs of treatment, replacing equipment and also for costs incurred as a result of the incident.

ROAD TRAFFIC ACCIDENTS

If you’ve been involved in a road traffic accident all parties should stop and give you their details. We will need as much information as you can provide and if you have a photograph of the vehicle involved or the scene of the accident this could help us to secure your claim.

POTHOLES

If a pothole in the road caused your accident, make sure you take a photo of it with something alongside to demonstrate its size. Potholes develop over time and the local authority is required to inspect and repair them in reasonable time. Any evidence you have from witnesses about the state of the road is invaluable as it may prove that the defect that caused your accident should have already been repaired.

HAVE YOU BEEN INJURED?

If you’ve been injured your medical records will be used to support the claim for compensation. In this case our experts will work with your medical team to assess the extent of injury and depending on the degree of injury, you may also need to attend a medical assessment. The Wiggle Legal team will make all the arrangements for medical help and provide any physiotherapy or other specialist care that may be required.

HIT AND RUN? DRIVER NOT INSURED? FOREIGN VEHICLE?

Sadly not every driver stops in the event of an incident. However, you can still claim from the Motor Insurers’ Bureau under the Untraced Drivers Agreement or Uninsured Drivers Agreement for UK vehicles, and the Green Card Scheme for foreign vehicles. To have the best chance of a claim it helps if you can note the make and colour of vehicle and get details (or even partial details) of the vehicle registration. If at all possible take a photograph on your mobile phone.
